Yes, you can

A claim does not end your tenancy and you do not need to leave. Many claims are made by council, housing association and private tenants who are still living with the problem and want it fixed.

What you may be able to claim for

  • Repairs to the problem and to what it has damaged
  • Compensation for the time you lived with the problem
  • Compensation if the problem has affected anyone's health
  • The cost of damaged belongings
  • Extra costs, such as heaters, dehumidifiers, cleaning or higher bills linked to the problem

What to do while the claim runs

  • Keep paying your rent. Do not withhold rent without taking advice first, because arrears can put your tenancy at risk
  • Report any new or worsening problem to your landlord in writing and keep a copy
  • Give access for inspections and repairs on the dates agreed

Will my landlord know?

Yes. A claim means your solicitor writes to your landlord. We will not contact your landlord until you have agreed with us that we should. If you are worried about how your landlord might react, read our guide on whether a landlord can evict you for claiming.

Do I need to move out?

No. Do not move out because of a claim unless you have taken advice, because it can affect your rights and your home.

What if I have lived there only a short time?

You can still claim, but your landlord normally needs to have been told about the problem and have had a reasonable chance to fix it first.

What if I am behind with my rent?
